On Friday, Warner Bros. Discovery initiated a lawsuit against the National Basketball Association (NBA) as it strives to retain broadcast rights for a package of live games.
“In light of the NBA’s unwarranted rejection of our effort to match a third-party offer, we have resorted to legal measures to uphold our rights,” stated the company’s TNT Sports unit. “We firmly believe that this action is not only our contractual entitlement but also serves the best interests of fans who wish to continue enjoying our top-tier NBA content with the variety and flexibility provided by our extensive WBD video-first distribution platforms, including TNT and Max.”
The media company is seeking to block the NBA from granting broadcasting rights to Amazon. This decision comes after Warner Bros. Discovery attempted to match a package involving television slots that was reportedly offered by Amazon or seeks monetary damages.
On Wednesday, the NBA announced agreements with Disney, NBCUniversal (Comcast), and Amazon concerning three different packages of games. This development concluded its nearly four-decade association with Warner Bros. Discovery’s Turner Sports. The new 11-year media rights contract is valued at approximately $77 billion—significantly higher than previous contracts due to soaring interest in live sports.
Responding to the lawsuit, NBA spokesman Mike Bass remarked that “Warner Bros. Discovery’s assertions are unfounded and will be addressed by our legal team.”
Earlier in the week, Warner Bros. Discovery indicated it had filed documents with the league to match one of these packages recognized as having been offered for $1.8 billion per year designated for Amazon. The tech giant’s agreement encompasses regular-season games along with an in-season tournament and select playoff matches. In their earlier media deal signed in 2014, matching rights were granted by MLB allowing incumbent companies an option for last refusal as they sought continued partnership status.
However, since Warner Bros. Discovery opted to match up against Amazon’s offer rather than NBCUniversal’s $2.5-billion-per-year agreement instead caused confusion over its validity according according to officials from both parties on Wednesday; they asserted that such matching qualifications were rendered void after their decisions shifted priority presentation methods entirely which differed between cable networks versus streaming services being unique entities).
