Former NASCAR Cup Series director Jay Fabian was found guilty of three misdemeanor charges related to animal cruelty, concluding a lengthy legal battle. Motorsports analyst and journalist Bob Pockrass reported the court’s verdict.
Fabian, who served as the NASCAR Cup Series director at the time, faced two felony and one misdemeanor charge in 2021. Following the allegations, he was asked to step down from his position. The Stock Car Association issued a statement:
“NASCAR takes this situation seriously and will continue to gather information as it becomes available. Jay Fabian will step back from his role until this matter is resolved. NASCAR will have no further comment.” (via Racer.com)
The court delivered its final verdict, and Bob Pockrass shared that Jay Fabian was sentenced to 90 days in jail, suspended as long as he successfully completes a five-year probation period. Additionally, Fabian is prohibited from owning dogs.
Reports indicated that an animal cruelty complaint was filed against Fabian on July 21, 2021, at approximately 3 pm. Officers discovered one deceased dog, one nearly deceased dog, and another alive but in dire condition.
According to the 2021 documents, Fabian “intentionally and with malice” deprived his dog, Jasper, of basic necessities required for life, causing the dog to suffer immense pain leading to a torturous death. His other dog endured extreme dehydration and starvation. The arrest warrant cited Fabian’s violation of Sections 14-360 (A) and 14-360 (B) of North Carolina Law.
Section 14-360(A) states that anyone who intentionally overdrives, overloads, wounds, injures, torments, kills, or deprives any animal of necessary sustenance is guilty of a Class 1 misdemeanor. Section 14-360(B) declares that anyone who maliciously tortures, mutilates, maims, cruelly beats, disfigures, poisons, or kills any animal is guilty of a Class H felony.

Prior to his promotion to the Cup Series director, Jay Fabian held the position of managing director of technical integration for NASCAR. He was hired by the sanctioning body in 2019 as the Cup Series director.
Following his promotion, Fabian stated:
“This is a fast-paced sport that is constantly evolving, and I’m thankful for this opportunity and eager to take on the challenge. Racing has been my passion for as long as I can remember. There is growing anticipation for the 2019 season, and I am excited to be a part of it. ” (via NASCAR )
